These Terms of Service (“Terms”) govern your use of Sportykle Lite (the “Service”), provided by Sportykle. By creating an account or using the Service, you agree to these Terms.
1. The Service
Sportykle Lite helps sports centre owners manage centres, members, staff, attendance, enquiries, and basic income/expense tracking. Features may change as we improve the product. The Service is intended for business / organisation use by adults authorised to manage a sports centre.
2. Accounts
- You must provide accurate registration information and keep credentials secure.
- One organisation owner account is associated with the data you manage in Lite.
- You are responsible for activity under your account.
- Notify us promptly at support@sportykle.com if you suspect unauthorised access.
3. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or fraudulent purposes.
- Upload malware or attempt to disrupt or reverse-engineer the Service.
- Infringe others’ intellectual property or privacy rights.
- Misrepresent your identity or affiliation.
- Abuse messaging or contact features to spam third parties.
4. Your content & data
You retain ownership of the member, staff, and centre data you enter. You grant us a limited licence to host, process, and display that data solely to provide the Service. You are responsible for having the rights and consents needed to store personal data of members and staff in the app (for example under applicable data-protection law).
5. Subscriptions & fees
Some features may require a paid subscription. Pricing, billing period, and renewal terms will be shown in-app or communicated before you pay. Unless required by law, fees are non-refundable once a billing period has started. We may change prices with reasonable notice for renewals.
6. Availability & changes
We aim for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice where practicable. We may update these Terms; continued use after the effective date constitutes acceptance.
7. Intellectual property
Sportykle Lite, including software, branding, and documentation, is owned by Sportykle or its licensors. These Terms do not grant you any right to use our trademarks except as needed to identify the Service.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. You are responsible for backups of critical operational data and for decisions you make using the Service.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPORTYKLE AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR INR 5,000 IF YOU HAVE NOT PAID FEES).
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, create risk for the Service or other users, or if required by law. On termination, your right to use the Service ends; sections that by nature should survive (including IP, disclaimers, and liability limits) will survive.
11. Governing law
These Terms are governed by the laws of India, without regard to conflict of law rules. Courts in Bengaluru, Karnataka shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply.
